The fact that a person's name appears on a birth certificate is not conclusive proof of paternity. Since there is no requirement that a father sign a birth certificate, a mother may list anyone whom she believes is, or wants to be the father.
The simple answer is "No" no one can force another party directly to undertake a test. The only way to do so to get the test mandated by a court of law. And even then, refusal is still possible.
As long as legal paternity has been established, an unmarried father retains all the same rights and protections as a married father.
DNA tests can be conducted without the father knowing, but the results are strictly for personal information and cannot be used in a court of law.
Under current California law, fathers have equal rights to not only have primary custody of a child, but to also petition for child support from the mother.
